TERMS AND CONDITIONS OF MEMBERSHIP/VISITORS
1. Princes Park Golf Course
a) The centre is managed by Paul Page Golf Academy Ltd.
b) The premises shall be located at Princes Park Community Stadium, Grassbanks, Darenth Road, Dartford, Kent DA1 1RT.
2. Data Protection
I agree that all data relating to my use of Princes Park Golf Course can be used by Paul Page Golf Academy Ltd.
We will not sell, distribute or lease your personal information to third parties unless we have your permission or are required by law to do so.
You are legally entitled to request details of the personal information which we hold about you, under the UK's Data Protection Act 1998.
3. The Company (Paul Page Golf Academy Ltd)
The company shall through its duly authorised representatives manage and operate the Princes Park Golf Course and deal with all matters in connection with it.
4. Acceptance
a) Upon acceptance of this application the member shall be issued with a Princes Park Golf Course card (which shall remain the property of the company) and shall be entitled to all the rights and privileges exercisable by the class of members for which his/her application for membership has been accepted.
b) MEMBERSHIP OF THE PRINCES PARK GOLF COURSE SHALL CONSTITUTE A BINDING CONTRACTUAL ARRANGEMENT BETWEEN THE COMPANY AND THE APPLICANT UPON THESE TERMS AND CONDITIONS OF MEMBERSHIP AND THE RULES AND REGULATIONS OF THE PRINCES PARK GOLF COURSE AS ARE FROM TIME TO TIME IN FORCE.
c) All members may cancel their membership by notice in writing to the company within ten days after the application for membership of the Princes Park Golf Course is accepted by the company, whereupon the Annual Fees if any shall have been paid (and any monthly membership charges paid in advance) will be refunded in full, except in so far as provided in this sub clause.
d) Membership Cards issued to all users must be shown at the club house to gain entry every time a visit is made. Cards are not transferable and any use other than by the member will result in cancellation of that membership with no refund available.
e) Having purchased a Princes Park Golf Course package and you do not attend, you will not be entitled to a refund of your fee unless in exceptional circumstances and this will only be at the discretion of the Business Owner.
f) All Members and visitors will agree to abide by the rules and guidelines in place relating to dress code, course etiquette, local rules, out of bounds and staked trees. These rules and regulations are displayed at the club house.
5. Limitation of liability
a) In consideration for the company accepting his/her application for membership of the Princes Park Golf Course, and for he/she becoming and remaining a member of the Princes Park Golf Course, the member agrees that:
i) Neither the company, nor its employees or agents shall be liable for any loss damage or theft of any property belonging to, or brought onto the Princes Park Golf Course premises by the member/visitor or any guest of the member, occurring upon the Princes Park Golf Course premises.
ii) Neither the company, nor any employees or agent of the company shall be responsible for any death, personal injury or illness occurring upon the Princes Park Golf Course premises or as a result of the use of the facilities and/or equipment provided by the Princes Park Golf Course, except to the extent that such death, personal injury or illness arises from any negligent act or omission of the company or its employee or agent.
6. Physical condition of member
a) The member warrants and represents that he/she is in good physical condition and that he/she knows of no medical or other reason why he or she is not capable of engaging in active or passive exercise and that such exercise would not be detrimental to his/her health, safety, comfort or physical condition.
7. Assignment
Membership is non-transferable.
8. Membership
a) Membership shall be divided into various categories including: Adult Member, Senior Member (65+), Junior+ Member (age 12-18), Junior Member (age under 12). Other types of membership may also be available. All categories of members shall be subject to these terms and conditions and the rules and regulations of the Princes Park Golf Course as are from time to time in force.
b) Junior membership is only up to the age of 18 years.
9. Membership Fees
a) All users of the Princes Park Golf Course, have the option of membership or Pay & Play.
b) Upon joining as a member, members shall pay either by a one off annual payment or by direct debit, which shall become due immediately upon the applicant being accepted as a member.
c) Members may elect to pay their annual membership fee in 12 monthly instalments. Fees shall be paid by direct debit and are payable monthly in advance.
d) Monthly membership fees must be paid in accordance with the conditions set out irrespective of actual usage of the Princes Park Golf Course.
e) The company may increase membership fees, and shall give the member not less than 30 days written notice of any such increase.
10. Expulsion of members and termination of membership
a) The company may terminate the membership of any member:
i) Without notice and with immediate effect if the member’s conduct, whether or not such conduct is the subject of complaint by another member or members, is such that in the reasonable opinion of the company, it may be injurious to the character or interests of the Princes Park Golf Course, or is such that it renders the member unfit to associate with other members of the Princes Park Golf Course.
ii) Without notice and with immediate effect if the member shall have committed any breach of these terms and conditions or of the rules and regulations of the Princes Park Golf Course as are from time to time in force.
iii) By notice in writing if any part of the annual or monthly membership fee which is due and payable remains unpaid 30 days after the due date for payment.
iv) Upon not less than 30 days notice in writing if the company is of the opinion that the member is not a suitable individual for continued membership of the Princes Park Golf Course.
All decisions of the company under this clause are final and binding.
b) A member whose membership is terminated shall forfeit all the privileges of membership with immediate effect without claim for any refund of his/her annual or monthly membership fee and shall remain liable for any part of the annual or monthly membership fee which remains due and owing to the company at the date of termination of membership. On termination of his/her membership, the member shall return forthwith his/her membership card and any other evidence of membership provided to that member by the club and shall settle any outstanding debts.
c)
i) It is the responsibility of the member to cancel their direct debit with their bank. The company cannot be held responsible for any subsequent payments that are processed due to the failure of the member to do so.
ii) Refunds can not be given for cancellation of Annual membership.
d) In the event of the death of a member during the currency of his/her membership of the Princes Park Golf Course, the obligation to monthly Direct Debit charges shall cease with effect from the date of death.
11. Princes Park Golf Course Club Facilities
a) The company reserves the right to make reasonable alterations to the types of facilities/special events provided without notice at its absolute discretion and the company shall not be liable for any loss occasioned by such alterations.
12. Hours of opening
The Princes Park Golf Course’s normal hours of operation and the hours in which facilities are available to members are obtainable from the company website and upon request. Such hours may be lengthened or shortened at the absolute discretion of the company with or without any prior notice to members being given. The company shall endeavour to give reasonable notice of any lengthening or shortening of such hours. On occasions when necessary maintenance is required, the Princes Park Golf Course may be closed, for which members will be given not less than 14 days notice of any such closure. Any refund given as a result of closure will only be made at the sole discretion of the Manager. The company reserves the right to verify, or require proof of all information given in order to obtain such membership could result in the cancellation of all membership rights and/or reimbursement of all monies due to the company.
